Disciplinary Committee releases verdict on Sun City’s Appeal

The FUFA Disciplinary Committee released the verdict regarding the appeal by Sun City Football Club following a decision by FUFA Competitions Committee (FCC) that had seen them lose the final of the Kitara Regional League by forfeiture against Boma Young FC .

The Disciplinary Committee is headed by Geoffrey Ojok Odur and had the following findings and recommendations;
  • The Tournament Organising Committee (TOC), in this case Kitara Region Football Association is the first instance body for this case.
  • FUFA Competitions did not have jurisdiction to hear and decide the petition that was lodged before it by Boma Young FC.  A decision decided by a body without jurisdiction is not enforceable or implemented.  The said decision passed on the 15th day of July, 2015 is hereby set aside.
  • The FUFA disciplinary Committee also has no jurisdiction to hear the merits of the case save for the Appeal that was before it. It therefore cannot decide the merits of the case.
Remedies;
  • Boma Young FC is advised to follow the procedure of challenging the decision issued by the Kitara Region Executive Committee in as far as the promotion of Sun City is concerned before the regional Judicial Committee.
  • The decision of FUFA Competitions Committee is set aside.

The decision by the FUFA Disciplinary Committee takes effect immediately.
